Smoke Free Workplaces
Anyone who works in or visits an enclosed workplace is not permitted to smoke. This includes employers, employees, voluntary workers, customers and members of the public.

The ban on smoking covers all enclosed areas of a workplace including staff rooms and areas enclosed with a roller door or movable roof or wall. Smoking is permitted outside provided the area is not enclosed and the workplace does not have an individual policy that prohibits smoking in outdoor areas.

Employers should not provide ash trays, matches or lighters or other things to facilitate smoking in enclosed workplaces.

There are some workplaces that are exempt from this law.

Eating Establishments
All restaurants/cafes and licensed premises are required to be smoke-free. The occupier or person in charge must ensure that ash trays, matches or lighters are not available to facilitate smoking. It is also the responsibility of the occupier to ask any patron who lights a cigarette to extinguish it immediately or to move to an outdoor area where smoking is permitted.

No Smoking signs must be displayed at the entrance to all retail shopping centres, bingo area/centre, licensed premises, dining areas or an enclosed restaurant/cafe.

Outdoor Dining or Drinking Areas
Smoking is prohibited in outdoor dining or drinking areas where the area has a roof in place and the total actual area of the wall surfaces exceeds 75% of the total notional wall area. No smoking signs must be displayed.

Outdoor dining/drinking areas must be furnished with appropriate furnishings suitable for the outdoors.

Unlike an enclosed premises, the smoking status of an outdoor area can change depending on the position of any movable and retractable awnings, roofs or umbrellas. No smoking signs must be displayed if an outdoor dining/drinking area becomes enclosed.
