Enclosed licensed premises have been required to be smoke-free since 1 July 2007 in line with the workplace smoking bans introduced in 2006.

Licensed Premies
Smoking is not permitted in an enclosed licensed premises at any time, including outside trading hours. This ban affects owners or managers, employees, volunteers, customers and members of the public. No smoking signs must be displayed.

The smoke-free status of an enclosed licensed premises does not change even when large windows or doors are opened. This is regardless of whether the roof or walls are permanent, temporary, open or closed.

Tobacco Product Vending Machines
Tobacco product vending machines can only be located in a licensed premises in the line of sight of and within five (5) metres of the outer edge of the bar counter. They can also be located at approved venues and casinos and immediately next to the service counter in bottle shops.

The same laws apply to tobacco product vending machines as to other tobacco retail outlets.

Outdoor Dining or Drinking Areas
Smoking is prohibited in outdoor dining or drinking areas where the area has a roof in place and the total actual area of the wall surfaces exceeds 75% of the total notional wall area. No smoking signs must be displayed.

Outdoor dining/drinking areas must be furnished with appropriate furnishings suitable for the outdoors.

Unlike an enclosed premises, the smoking status of an outdoor area can change depending on the position of any movable and retractable awnings, roofs or umbrellas. No smoking signs must be displayed if an outdoor dining/drinking area becomes enclosed.

No Smoking signs can be obtained free of charge by contacting Councils Environmental Health Team on 5760 2683.
