Advertisement - Notice of Intention - Airport Lease

The Council wishes to advise that in accordance with section 190 of the Local Government Act 1989 (Act), the Council intends to enter into a lease with Benalla Aero Club Inc.for premises known as Hangar 21, Benalla Airport, Samaria Road, Benalla 3672 – (see image). 

The principle terms of the lease will be:

  1. A term of ten years.
  2. A commencement rent will be calculated at a rate of $5 per square metre of the area of the Premises (plus fire services levy) per annum plus GST.
  3. Rent is to be reviewed annually by CPI adjustment on each anniversary of the commencement date of the lease, except for on the 5th anniversary of the commencement date of the lease on which the rent will be reviewed to market value.
  4. In addition to rent, the tenant will pay a development fee will be calculated at a rate of $2 per square metre of the area of the Premises per annum plus GST. The development fee may be called upon by Council once in each five year period of the Term and will be increased annually by CPI adjustment.

A person may make a submission on the Proposal.

Any person proposing to make a submission under section 223 of the Act must do so by Monday 16 October 2017.

All submissions will be considered in accordance with section 223 of the Act.

Any person requesting to be heard in support of his or her submission is entitled to be heard before the Council (or a Committee established by Council for this purpose) or be represented by a person acting on his or her behalf, and will be notified of the time and date of the hearing. Should a hearing be required, the hearing is scheduled to be on Wednesday 25 October 2017.
