Tobacco retailers play an important role in preventing children and adolescents from obtaining tobacco products and must comply with the laws under the Tobacco Act 1987 regarding the sale and display of these products.

Signs to be displayed at tobacco retail outlets including vending machines
Tobacco retailers must display an A4 "WE DON'T SELL TOBACCO TO U/18S" sign and an A3 black and white health warning sign. These signs must also be displayed on tobacco product vending machines. In addition to this it is recommended that retailers display the sign which states what the accepatable forms of identification are for proof of age when buying cigarettes.

Cigarette Sales to Minors
Cigarette sales to minors laws aim to reduce the supply of cigarettes to minors in order to stop the initiation of smoking and the transition from experimental to regular smokers. This will assist in reducing smoking prevalence within the community which over time will have positive health outcomes.

Managers and employers have a responsibility to ensure that their staff do not sell cigarettes to people under the age of 18 years.

Both the employee and the manager or employer can be held responsible when tobacco products are sold to a person under 18. On the spot fines can be issued to an individual or a company when an offence is committed. To reduce the sale of cigarettes to people under 18, managers and employers are advised to train all their staff every six (6) months and ensure that a written acknowledgement of the training is completed and filed.

Display and Advertising Restrictions
From 1 January 2011, any display of tobacco products or packaging is banned. For further information please refer to the Tobacco retailers fact sheet and the Tobacco Retailer Guide .

Some retailers may use a price board to advise customers of the tobacco products that are available for sale. The price board must comply with strict specifications.

A prescribed graphic health warning sign must be displayed on or immediately next to the priceboard. Copies of these signs can be obtained by contacting the Tobacco Information Line on 1300 136 775.

Complaints
Any complaints regarding the sale of cigarettes to a person under 18 or the sale of single cigarettes can be reported to Councils Environmental Health Team on 5760 2683. Note that it is also illegal for someone to purchase cigarettes on behalf of a minor.
