Notice of Intention to Deviate a Road

Benalla Rural City Council (Council), acting under clause 2 of Schedule 10 and section 189 of the Local Government Act 1989 (Vic) (Act), proposes to:

  1. deviate the Lima Road, Lima, from the land shown hatched on the plan below (Unused Road) to the location shown cross-hatched on the plan below (Constructed Road); and
  2. following the deviation of Lima Road, transfer:
    a. that part of the Unused Road to the west of Lima Road, to the owner of 556 Lima Road, Lima, being the land contained in volume 10321 folio 980; and
    b. that part of the Unused Road to the east of Lima Road, to the adjoining owner of 487 Lima Road, Lima, being the land contained in certificate of title volume 10321 folio 979,

for nil monetary consideration, on the basis that the adjoining owners shall consent to the deviation of Lima Road with effect that the Constructed Road forming part of their properties will be vested in fee simple in Council.

Interested persons are invited to make a submission on the proposal in accordance with section 223 of the Act. Council must receive submissions by 5pm Wednesday 22 September 2021

All submissions will be considered in accordance with section 223 of the Act.

Submissions may be included in an agenda for a meeting of the Council that will be made available to the public.

Written submissions are to be addressed to the Chief Executive Officer, and may be hand delivered to Council's office at 1 Bridge Street East, Benalla, VIC 3672 or posted to the following address:

Any person making a written submission and requesting to be heard in support of their written submission is entitled to appear in person, or may be represented by a person acting on their behalf, before a meeting of Council or a committee of Council.
