Swimming Pools & Spas

Owning or installing a swimming pool or spa comes with important responsibilities to ensure safety and compliance with regulations. Benalla Rural City assists residents in understanding and meeting these requirements.

Registration Requirements

All swimming pools and spas capable of holding water deeper than 300mm (30cm) must be registered with the Council. Owners need to meet the following steps to complete the registration process:
  • Register your pool or spa through the Customer Portal, selecting the “Register Swimming Pool/Spa” option.
  • Receive confirmation of your registration and next steps. You will also be informed of the applicable safety standards.
  • Lodge a safety barrier compliance certificate by the specified due date.

Please note that failing to register or comply with safety standards may result in penalties.

Safety Barrier Compliance

Owners are responsible for ensuring their pool or spa has a compliant safety barrier. This includes undertaking regular inspections and addressing any issues.

  • Inspection Requirements: Barriers must be inspected by a registered building practitioner or surveyor. Council offers a barrier inspection service that can be booked via email at building.info@benalla.vic.gov.au or by calling 03 5760 2665. Alternatively you can search the VBA website to find a registered practitioner to undertaken a swimming pool safety barrier inspection.
  • Compliance Certificates: After inspection, owners must lodge a safety barrier compliance certificate with Council.
  • Barrier Maintenance: Conduct regular checks using tools provided by the Victorian Building Authority (VBA) to avoid paying for multiple inspections.

Important Deadlines and Fees

All swimming pool owners need to access their registration through the Customer Portal, this will provide the applicable barrier standard and the next compliance certificate due date. It is the owner’s responsibility to ensure swimming pool barrier compliance certificates are lodged on time. Failure to lodge the certificate within the time frame with result in further action and possible fines.

Only new swimming pools will need to be registered with the portal if you swimming pool existed before 1 July 2024 then it will already be registered and can be accessed through the Customer Portal if you are having any issues accessing the portal please contact the building department and we can assist you.
