Notice of Intention to Lease Hangar 13 and 28, Benalla Airport

Benalla Rural City Council (the Council) gives notice under Section 115 of the Local Government Act 2020 (the Act) of its intention to enter into a lease with Luke Bourne in respect of the premises described below (Proposal).

The premises are known as Hangar 13 and Hangar 28, Benalla Airport, Samaria Road, Benalla Victoria 3672.

The principal terms of the lease will be:

  1. A term of five years commencing on 1 July 2022 with an option for four further terms of five years.
  2. To waive leave costs until 30 June 2023, excluding Fire Services Property Levy. From 1 July 2023, all applicable lease fees will be payable for the remaining term of the lease.
  3. The lease will be adjusted annually by the All-Groups Consumer Price Index, except for the 5th anniversary on which the rent will be reviewed to market value.

Persons wanting to make a submission on the Proposal under Section 223 of the Local Government Act 1989 must do so by 5pm Friday 27 May 2022. All submissions will be considered in accordance with Section 223 of the Local Government Act 1989.

Submissions should be addressed to the Council’s Chief Executive Officer and can be:

  • delivered to Council's Customer Service Centre, 1 Bridge Street East, Benalla
  • posted to PO Box 227, BENALLA VIC 3671
  • emailed to council@benalla.vic.gov.au

Any person requesting to be heard in support of their submission is entitled to be heard before the Council or a Committee established by the Council for this purpose. Any person may be represented by a person acting on their behalf and will be notified of the time and date of the hearing.

Should a hearing be required, it is scheduled to be on Wednesday 22 June 2022.
