DECLARATION OF BOATING ACTIVITY EXEMPTION 

Marine Safety Act 2010 (Vic)

Safe Transport Victoria makes the following declaration under section 203(3) of the Marine Safety Act 2010 (Vic).

For the purposes of boating activity conducted by Northern Fireworks on the waters of Lake Benalla, persons and vessels involved in the Fireworks Display on Lake Benalla are exempt from the following requirements:

Waterway Rules made under the Marine Safety Act 2010 / Marine Act 1988

  1. Clause 93.1 of Schedule 93 – Vessels with engines prohibited on Lake Benalla

Subject to the conditions detailed below:

  • Masters of event support vessels are exempt from item 1 for the duration of the event.
  • All occupants of vessels involved with the event must wear a lifejacket at all times during the event and vessels must have all prescribed safety equipment.
  • The exemptions apply from 1:00pm to 11:30pm on Saturday 20 April 2024 within the exclusion zone waters – whole of Lake Benalla
  • The exemptions apply provided the stated safety controls and undertakings detailed in the application form and associated documentation are adhered to.
